Rainbow Anomaly in Modified ACP Scheme
Dear Friends

As per the modified ACP scheme, the entire service will be taken into account and three upgradations will be ensured for every 10 years of qualified service treating the mergerd grade as a single grade.
In this connection, I wish to highlight an anomaly which will affect some staff who were promoted after 1-1-2006 by citing an example:

Take the case of a JE-II who was promoted to the grade of JE-1 before 2006. He was granted an increment as a promotional benefit since he was promoted before the implementation of sixth CPC. While fixing his pay as on 01-01-2006 he gets the benefit of that increment and he continues to enjoy that benefit.

Take the case of another JE-II, who was promoted to the grade of JE-1 after 01-01-2006, though he was granted one increment during his promotion, the effect of increment is nullified due to merger of grades of JE-II/JE-1 and while fixing the pay to the revised pay scale as per sixth CPC he looses that increment.

This is a grave anomaly due to which one section of employees suffer for no fault of their own

Dear Hari,
Those who promoted with in the merged cadre,the situation is same.In our category these cadres are non-selection post.But some nontechnical category these cadres were selection posts.In this case they have to sacrifies seniority also.Every pay rivision, effective date and implimentation date will make much diffrence among staff who promoted or retired.
By exercising option of taking benifit of CPC from later date instead of 01/01/2006,in some cases we can neutralise these damage.Before exercising option correct calculation to be done to ensure benifit.Those who got promotion within the merged cadre between 1st july and 31st dec. may get benifit. Time limitation for exercising option may condoned by competent authority.Another thing we cannot predict how the future orders will affect.

Sir,
We are working as Assistant(A.D)in the architectural wing of C.P.W.D. recruited directly to this cadre in the pre revised scale of Rs.5500-150-8000. All of us possess Diploma in architectural assistantship which is the qualifcation required for this postand we are at par with the J.E's of our department.
We would like to express in this forum the anomolies arising to our cadre out of the implementation of the sixth pay commisssion and the modified A.C.P. scheme.

As per the 5th pay commisssion ACP scheme we get our 1st ACP after completion of 12 years -the scale of pay Rs.6500-10500 and after completion of 24 years the next ACP is Rs.10500-300 -16000.

We are a peculiar category in the entrire central govt organisagtion where there are only 220 such Asst.(A.D)'s in the whole country. The first A.C.P is eq. to the Technical Officer of our dept., which is the only promotion available to us, which is of very few numbers and not proportionate to the strength of the Assistants, which would ultimately facilitate only one or two assistants to avail that post. But in our dept., all the persons recruited in this asst. (A.D) cadre by way of direct recruitment possess only diploma qaualifcation. After the promotion as technical officer the person retires as technical officer only without any higher promotion.

5th pay commssion brought a relief to our cadre by giving 2 A.C.Ps (as a time scale promotion) one in 12 years in the prerevised scale of Rs.6500-10500 (T.O. cadre) and after 24 years Rs.10500-300-16000 (architect cadre.).In such situation we have Assistants who have completed 12 years and 24 years of service and received the benefits of 5th paycommisiion A.C.P. benefits. But after 6th P.C. people who have completed 24 years of service before 31-08-08 only are the luckiest to get the 2nd a.c.p as per hierarchy with all its benefits.
Due to this the official, who have already completed their 24 years before 1.09.2008, falls into the next pay band PB3 15600-39,000 with a grade pay of Rs. 6600. Whereas we Assistants, who are on the verge of completing even our 24 years, are still in the pay band PB-2 9300-34,800 with a grade pay of Rs. 4600.

After the notification of 6th paycommisssion and MACP scheme the officials who have completed less than24 years of service as on 1-09-08 will get only a difference in the grade pay(our present grade pay is Rs. 4600) of Rs.200 as the next grade pay in the hierearcy of the PB-3 is Rs.4800.

Where as being in the same cadre, with same resposnsibilities, same qualifications, the official sitting in the next seat is getting a grade pay of Rs.6600 (which falls in to the next pb-5) because of the 5th paycommsion A.C.P. This is a great injustice done to the officials of this cadre. Because of the MACP. (VI P.C.), there is a pay difference of Rs. 11000, between the officials who have completed 24 years on or before 1.09.08 and who have completed after the prescribed date.

As per the modified A.C.P scheme official who has completed 20 years of service will get grade pay of Rs.4800 and after 30 years Rs.5400 only. Whereas official who has served 24 years before implementation of 6th pay commission is getting Rs.6600 as grade pay and after complettion of 30 years Rs.7400. In the same cadre with same resposiblility sitting in the next seats the officials have parity in pay. which is injustice to our cadre. since only few of us are there in this cadre all over India(app.120 officials) this goes un noticed.

Therefore we request this forum to discuss and suggest us what to do rectify this anomoly. We are helpless. Please help us. How to represent our case and get the justice.
